About these terms and conditions

These terms and conditions of sale ("Terms of Sale") apply to your purchase of goods from Digital First (referred to here as "we", "us" and "our") through digitalfirst.co.uk (the "Website"). When we refer to "you" and "your" we mean you the user of the Website.

In addition to these Terms of Sale important information about your order is set out in our Returns Policy. By agreeing to these Terms of Sale you are also agreeing to the Returns Policy. You should read both of these documents carefully before buying anything from the Website.

We reserve the right to change the Terms of Sale and the Returns Policy at any time. Any changes made to the Terms of Sale or the Returns Policy will be effective for all new orders placed after the change is published on the Website.

Availability

Despite our best efforts there may be occasions where the product you have ordered is not available. If products are not available, we will notify you as soon as reasonably possible and provide a refund of the money paid to us including delivery charges, unless we agree a longer delivery period with you.

We reserve the right to withdraw any products from the Website at any time before we accept your order and we will not be liable to you or anyone else, for withdrawing those products.

Placing an order

Your order constitutes an offer to purchase goods from us. Where a single purchase comprises of several items your order constitutes a separate offer in respect of each item.

Step 1 New or existing customer

For new customers:

Click on the 'continue' button in the new online customers section. You will be directed to the delivery section.

For existing customers:

Simply enter your e-mail address and password and click the 'sign in' button and the details you have previously used will be called up. You will be asked to either confirm that you wish to use the delivery address and card payment details you have entered previously or enter alternative details.

Step 2 Delivery

New customers should enter their delivery details in full.

Step 3 Billing and Payment

New customers should enter their payment details and a contact e-mail address. You will then be prompted to choose a password. Returning customers should only enter a password here if they wish to change their existing password. Once this section is complete customers should click on the 'confirm' button.

Step 4 Confirm your order details

This is your final opportunity to amend the details you have filled in before your order is placed. Once you are happy that the details are correct click on the 'confirm' button.

Step 5 For your records

You will be directed to the order confirmation page. This will give you a record of your order details including the delivery address, the total amount of your purchase and your order number. This page does not indicate that we have accepted your order and does not form a binding contract.

Order acceptance

After placing an order you will receive an e-mail from us acknowledging that we have received your order. Please note that this e-mail does not mean that your order has been accepted.

Acceptance of your order will only take place when we despatch the goods to you. We will send you an e-mail that confirms that the product is being despatched to you (the "Despatch E-mail"). Until your product has been despatched no contract will have been formed between you and us.

Payment

You can pay for your goods by any of the following methods: Visa, Mastercard, JCB, Delta, Switch/Maestro or Solo. We will take payment from your card at the time you place your order. We will contact you if we have any problems taking payment from the card detail you provide during the order process. Taking payment does not mean we have accepted your order and, in the event of us not accepting your order, a full refund will be given as soon as reasonably possible (and in any event within 30 days of us advising you that your order has not been accepted).

All prices shown on the Website are inclusive of VAT and other applicable taxes unless we have agreed in writing with you otherwise. The prices shown do not include delivery fee, which will be added to your total order price prior to your submission of an order to us.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent a Despatch E-mail.

The standard price for next day delivery in the UK is £7.99. Next day delivery is only available on goods ordered before 5pm on Monday to Thursday. Additional delivery options are available where you require delivery by a particular time and these are detailed on the Website.

Pricing errors

Although we try to ensure that the prices quoted on the Website are accurate, and the products have been fairly described, mistakes can happen. If, after we have accepted your order, we discover an error in the price of a product, or a material error in the description of the product, we will inform you as soon as reasonably possible, and we will give you an option to reconfirm your order on the basis of the adjusted information or to cancel it.

If we are unable to contact you using the contact details you provided during the order process we will treat the order as cancelled and notify you by email of this.

If you decide to cancel your order after we have informed you of a pricing error and you have already paid for the goods, we will give you a full refund as soon as reasonably possible (and in any event within 30 days of cancellation).

Delivery

We operate a next day delivery service subject to certain conditions. Details are available on the page Shipping Costs and Delivery Times. Although we endeavour to deliver when we say we will, there may be occasions where this is not possible due to reasons outside of our control. In these situations we will inform you as soon as reasonably possible.

Although we allow you to specify a different delivery address from your billing address, you are solely responsible for ensuring that we are able to make delivery to this address and that you are available to accept delivery at this address on the delivery date. All risk associated with the goods and title in the goods passes from us to you on delivery of the goods.

Cancelling your order and returning your goods

Cancel before despatch

You may cancel your order for all goods at any time before we send you the Despatch e-mail.

Cooling off period

The Consumer Protection (Distance Selling) Regulations 2000 also give you a right to cancel your contract with us within 7 working days of receiving your goods. Please see our Returns Policy for more information on this.

Returns

If you discover that your goods are faulty then you may return them to us. Please read our Returns Policy for more information about our return period and how to return the goods.

Our liability

Our entire liability to you under these Terms of Sale and Returns Policy shall not exceed the price paid for the goods you have purchased through the Website.

We will only be liable for any breach in connection with these Terms of Sale for the losses you suffer as a result and to the extent that they were a foreseeable consequence to both of us at the time your order is accepted. We will not be liable for any loss of revenues, profits, contracts, data, business or anticipated savings; or any loss of goodwill or reputation; arising in connection with any provisions under these Terms of Sale.

The above statement shall not limit or affect our liability in the event that any goods we sell are found to be unsafe or if something we do negligently causes death or personal injury.

Where you buy as a consumer, these Terms of Sale and the Returns Policy will not affect your rights under law which cannot otherwise be excluded.

Warranties

All cameras and lenses sold by Digital First come with a 5 year warranty where stated. This is broken down as follows:

  • 1st Year is fully covered by your manufacturer's warranty.
  • 2nd Year is fully covered by your manufacturer’s warranty or if they only offer a 1 year warranty Camerabox will fully cover the warranty for the 2nd year.
  • 3rd Year, 4th Year & 5th Year Digital First will cover parts only of any warranty repair, labour costs are the responsibility of the purchaser

NOTE: ACCIDENTAL DAMAGE OR MISUSE WILL VOID YOUR WARRANTY

Products are registered for warranty coverage from the date of delivery. There is no need to register your product as this is a process which will be actioned automatically.

Unless specifically stated otherwise in the product description, our cameras and lenses come with a one or two year warranty from the manufacturer followed by a three, four or five year warranty from us; therefore your goods are covered for a total of five years from the date of delivery and are subject to the conditions detailed in the product warranty documentation.

If you have problems during the first or second year of using any camera or lens purchased from us, you should consult your manufacturer's warranty which will have been provided with the goods at the time of delivery. Unfortunately we cannot give any advice on the manufacturer's warranty. If you have any questions you should contact the manufacturer directly.

If you have problems using a camera or lens purchased from us after the first year from the date of delivery, you should contact us, in which event we may be able to offer you a repair or exchange depending on the circumstances.

General terms

We will not be responsible for any delay or failure to comply with the Terms of Sale or the Returns Policy if the delay or failure arises from any event which is beyond our reasonable control. Such event would include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, war, civil unrest, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods.

If you breach these Terms of Sale or the Returns Policy and we take no action, we still be entitled to use our rights and remedies in any other situation where you breach the Terms of Sale or Returns Policy.

In the event that one or more of the terms set out in these Terms of Sale or in the Returns Policy is held to be invalid by a competent authority, the remaining terms shall continue to have effect and you will still be bound by them.

Personal information, such as your contact details, that you provide to us during the order process will be kept and used by us in accordance with our Privacy Policy.

These Terms of Sale, together with the Terms of Use, Privacy Policy and Returns Policy constitute the entire agreement between you and us in respect of your purchase of goods from us.

Governing law

These Terms of Sale shall be governed by English Law. Each of us agrees to submit to the non-exclusive jurisdiction of the English Courts.
